| A trademark is a brand name for a product. A trademark represents the goodwill and reputation of a product and its source. Its owner has the right to prevent others from trading on that goodwill by using the same or a similar trademark in a way that is likely to cause confusion as to the source, origin or sponsorship of the products, or in a way that causes dilution of the distinctive quality of the mark. |
| How should I use the BOOKS ON TAPE® trademark? | TOP |
| The BOOKS ON TAPE® trademark should only be used to refer to the brand of audiotape products produced and sold by Books on Tape, Inc (B-O-T). It is proper to say "I recently rented a BOOKS ON TAPE audiobook," but it is improper to say you "enjoy renting BOOKS ON TAPE." In the second example, it would be proper in that instance to say that you "enjoy renting audiobooks, and BOOKS ON TAPE® audiobooks are always the best quality audiobooks." |
| How do I know if I am misusing the BOOKS ON TAPE® trademark? | TOP |
| In any instance where you use BOOKS ON TAPE, ask yourself, am I using this to refer to the brand of audio book produced and distributed by Books on Tape, Inc., or am I using it to refer to an audiobook, regardless of its source? If you intend to refer to a Books on Tape, Inc. product, please show our mark in all capital letters, or with the � symbol, or in italics. If you intend to refer to any audiobook product, regardless of its source, please use the term "audiobook" and not "books on tape." Another general rule is that a trademark should only be used as an adjective and never as a noun or verb. |

| In the mid-1970s, Books on Tape, Inc. pioneered the commercial audio book industry and coined the term BOOKS ON TAPE® as its proprietary trade name, trademark and service mark. It has registered BOOKS ON TAPE® as its trademark and service mark in the United States Patent and Trademark Office, and thus owns the exclusive right to use that term in relation to audio books and related services. Although a number of other producers create audio books, only Books on Tape, Inc. produces and markets BOOKS ON TAPE® brand audio books. |
